Kylie Minogue caused quite the “lo”commotion the other week, by taking legal steps to prevent Kylie Jenner monopolising the name KYLIE.
Jenner (who appears in reality TV show Keeping Up with the Kardashians) applied to trade mark KYLIE in the US, as her make up and clothing lines increase in popularity.
However, Minogue filed an opposition to Jenner’s trade mark application on the grounds that it would cause confusion amongst fans and dilute Minogue’s own KYLIE brand.
Minogue’s lawyers argue that she has been in the entertainment industry since 1979, and launched her first album, titled Kylie, in 1988. She has sold 80m records worldwide, and is noted for her “high-publicity humanitarian efforts.” The lawyers assert that “Ms Jenner is a secondary reality-television personality, who appeared on the television series Keeping Up With the Kardashians as a supporting character, to Ms Jenner’s half-sisters, Kim, Khloe and Kourtney Kardashian.”
Minogue is also opposing Jenner’s trade mark application on the grounds of prior right as she already owns trade marks for “Kylie” when it comes to recordings, perfumes, body lotion, moisturiser, jewellery, printed matter and “plastic character toys.”
