The role of the family members and the emotional and historic ties make a difference to the way that family companies are run, depending upon the level of participation of first, second or third and subsequent generations. Standard constitutions and shareholders agreements often “don’t fit” the family company model – whether the company is a general trading organisation or a vehicle for managing family wealth, often where that wealth originally stemmed from a family business which has been sold and there is a need to manage the wealth generated from a sale.
