From time to time you may find yourself involved in a dispute, which could be business related or about private legal rights and issues. Mediation offers a safe, flexible and confidential forum in which you can look to settle such a conflict whether it be a business, commercial, civil or employment dispute with the help of an independent facilitator.
Mediation has a number of significant benefits over the courts:
It can enable businesses or individuals involved in a dispute to avoid the time, cost and stress of litigation and taking or defending a claim through the courts.
It focuses as much on the future as on the past. Courts make judgments and decisions on what has happened. Settlements agreed in mediations can take account of what has caused the dispute or disagreement but also reflect what the parties’ own interests are for the future.
For example, it may be that you have a dispute with a customer or supplier but would both like to continue to do business together. The adversarial nature of litigation may make such an outcome impossible. A negotiated settlement in mediation may be able to preserve the relationship on agreed terms.
You have control over what settlement is agreed. You are not committed to a settlement unless and until it is formalised in a signed written agreement.
Mediation has been described like buying a new car. You may test drive a number before choosing which one is your preferred one. During mediation a number of settlement options may be offered and it is for you to choose which is best for you.
Statistics confirm that mediations have strong prospects of success. Statistics in 2018 confirm that mediations have a success rate of 89%, 74% achieving settlement on the day of mediation and 15% shortly after mediation.
We have been involved in cases in which parties were convinced at the outset that a mediation would be unsuccessful then be pleasantly surprised when they were able to agree a settlement at a mediation.
